In Homel v. Accurate Scale Co. et al., 15 L 388, summary judgment was granted based upon the argument that Accurate Scale Co. did not owe the plaintiff a duty of care as the scope of work did not include the allegedly defective and hazardous electrical panel. No appeal was filed.
