Court Finds Alleged Defect was De Minimis

In Woods v. Costco Wholesale Corp. et al., 16 L 2340, the plaintiff alleged that he slipped and fell in a crack in the pavement at Costco.  Chris Buenik and Kevin Lolli filed a motion for summary judgment based upon the argument that the defendant did not owe a duty of care and the alleged crack in the street was de minimis.  Summary judgment was granted and no appeal was filed.
