In a personal injury lawsuit allegedly involving permanent disability, the plaintiff filed counts of construction negligence, premises liability, and ordinary negligence against a construction subcontractor. The accident allegedly occurred when her motor vehicle struck the rear of a parked truck outside of a construction zone. Initially, the court granted in part and denied in part a motion for summary judgment filed on behalf of the construction subcontractor. However, as a result of a motion to reconsider based upon an error in the application of the law, the court reversed itself, thereby granting summary judgment to the construction subcontractor on all counts.
