Northern District of Illinois Federal Judge John J. Tharp ruled in favor of a Franco Moroney Buenik client in an insurance coverage case arising out of an armed assault in the lobby of a public housing apartment building in Chicago. The victim, who claimed permanent injuries from the shooting, obtained a $9.6 million dollar judgment in the Circuit Court of Cook County. Judge Tharp found that a policy sub-limit for assault or battery applied to the incident and limited the coverage to a total of $25,000 for both defense costs and indemnity.
